Please read the following terms and conditions carefully. You must not make any booking unless you are 18 years of age or older and understand and agree with the following terms and conditions.
These Booking Conditions set out the terms on which you contract with us for the arrangement and delivery of travel arrangements for your trip. By making a booking with us, you acknowledge that you have read, understood and agree to be bound by these Booking Conditions. We reserve the right to change these Booking Conditions at any time prior to you making a booking request.
These Terms and Conditions apply to all bookings made with us, whether through one of our consultants (in person, by telephone or email) or online via our website, and govern our relationship with you. In arranging travel products and services, we may act either as the principal or as an agent for the relevant travel supplier or principal operator. Where we act as an agent, your contract for the travel arrangements will be with the relevant Supplier or principal operator, and their booking terms and conditions will apply to those arrangements. In such cases, these Terms and Conditions will apply only to the provisions relating to our role as agent, including the sections headed Responsibility and General, unless otherwise stated. We will advise you before confirming your booking if we are acting as an agent, identify the relevant Supplier or principal operator, and you may be required to expressly accept their booking terms and conditions.
It is your responsibility to read and understand the applicable Supplier or principal operator terms and conditions, as they form part of your contract for the travel arrangements.
Please read these booking conditions carefully, as they apply to all bookings accepted by Forward Travel Pty Ltd ABN 33 164 377 832 (Forward Travel).
Although you should read all the terms and conditions, the following is a summary of the most important:
“we” and “us” means Forward Travel Pty Ltd (ABN 33 164 700 832), and where the context permits, its Consultants.
“Consultant” means an employee of Forward Travel Pty Ltd, with authority to book Products.
“you” means a person who makes a booking for a Product with us.
“your Consultant” means the particular Consultant or Consultants with whom you negotiate the booking of a Product.
“Supplier” means a third party company or person who provides Products, including a wholesaler of such Products.
“Product” means travel and holiday related products and services including accommodation, leisure activities and various forms of transport, including packaged combinations thereof.
“Travel documents” means any document (whether in electronic form or otherwise) used to confirm an arrangement with a Supplier, including (without limitation) airline tickets, hotel vouchers and tour vouchers.
Bookings may be made by contacting us directly on 1300 738 168 (Australia only) or +61 401 812 219, by email, through our website, or through your authorised travel agent acting on your behalf. A booking request constitutes an offer to purchase travel arrangements and is not accepted until we issue a written booking confirmation and receive the required deposit or other payment specified by us. Upon acceptance, a legally binding contract is formed between you and us, subject to these Terms and Conditions.
We reserve the right, at our sole discretion, to accept or decline any booking request without providing a reason. No employee, representative or agent of the Company, other than a duly authorised director of Forward Travel, has the authority to amend, waive or vary these Terms and Conditions or to make any representation, promise or undertaking regarding discounts, refunds, credits or other concessions unless confirmed by us in writing.
Our services commence upon our acceptance of your booking. From that time, we undertake work to arrange, coordinate and administer your travel arrangements, including services performed prior to your departure. This may include, but is not limited to, liaising with Suppliers, confirming reservations, preparing travel documentation, processing payments and providing pre-travel assistance. You also receive the benefit of our expertise, planning and administrative services undertaken in anticipation of and in connection with your booking.
Unless expressly stated otherwise, our services are limited to (a) arranging and coordinating your travel products and services supplied by third-party Suppliers; and (b) providing any travel products or services that we directly own, operate or control.
All Products that we quote on are subject to availability and may be withdrawn or varied by the Supplier without notice.
Unless otherwise stated, all prices are quoted in Australian Dollars (AUD), are based on twin-share accommodation, include GST where applicable, and are correct at the time of publication. The most up-to-date pricing is available upon request or from our website. Prices include only those products and services specifically listed in the relevant itinerary or booking confirmation.
Unless expressly stated, prices do not include international or domestic airfares, passport and visa costs, vaccinations, travel insurance, meals not specified in the itinerary, optional activities, emergency evacuation expenses, gratuities, personal expenses, or any other items not expressly included.
All prices are subject to availability and may change prior to confirmation of your booking at the discretion of the relevant Supplier. After your booking has been confirmed, prices may also vary due to circumstances beyond our reasonable control, including but not limited to fluctuations in foreign exchange rates, increases in airfares, fuel surcharges, government taxes, levies, fees or other Supplier-imposed charges. Any additional costs arising from such changes are payable by you.
Prices include all applicable taxes requiring payment prior to departure and may be subject to adjustment in the event of an increase in those taxes. On other occasions, you may be liable for taxes in addition to the quoted price of the Product. For example, there may be a local tax charged at some airports or resorts.
We reserve the right to correct any pricing errors, calculation mistakes or omissions at any time prior to the commencement of your travel. Any verbal quotation is provided as an estimate only and is not binding unless confirmed by us in writing.
We reserve the right to vary the price of your travel arrangements at any time prior to the commencement of your travel where increases arise from circumstances beyond our reasonable control. Such circumstances include, but are not limited to, adverse currency exchange fluctuations, increases in airfares, fuel surcharges, government taxes, duties, levies or other charges, or any increase in costs imposed by Suppliers.
Where a price increase is due solely to adverse currency exchange fluctuations, we will not increase the price after we have received full payment for your booking and will absorb the first 2% of any negative currency movement.
If a price increase exceeds 10% of the total cost of your travel arrangements, you may elect to cancel the affected booking and receive a refund of all monies paid less deposit in respect of those travel arrangements, provided you notify us in writing within 7 days of the date of the surcharge notice. Failure to notify us within this period will be deemed acceptance of the revised price.
A deposit is payable at the time of booking to secure your travel arrangements. Unless otherwise stated, the required deposit is the greater of 15% of the total booking value per person or AUD $1,000 per person, and must be paid within seven (7) days of written confirmation of your booking. Certain travel arrangements, tours or Suppliers may require a higher deposit or full payment at the time of booking. Where applicable, your Consultant will advise you of the required payment terms prior to confirmation of your booking.
For bookings with a total value of less than AUD $1,000 per person, full payment may be required at the time of booking. Where travel arrangements include domestic flights, permits, peak-season accommodation, or other services requiring advance payment, payment in full may be required at the time of booking. Such components may be subject to the Supplier’s cancellation terms and may be non-refundable.
All deposits are non-refundable in the event of a change of mind or cancellation by you, except where required by the Australian Consumer Law or where we cancel your travel arrangements for reasons other than Force Majeure. The deposit represents payment for services already provided or commenced by us, including consultation, itinerary preparation, booking administration, processing and confirmation of your travel arrangements, and related pre-travel services.
Services, reservations or allocations may not be held or guaranteed until the required deposit has been received. If payment is not received within the required timeframe, services may become unavailable or prices may increase. You will be responsible for any additional costs arising from such changes, and we accept no responsibility where services are no longer available due to non-payment.
Payments made by direct deposit may take up to three (3) business days to be received and processed. If you choose this payment method, you must ensure payment is initiated sufficiently in advance of the due date and notify your Consultant once payment has been made.
The lead traveller or person making the booking confirms that they are authorised to accept these Terms and Conditions on behalf of all travellers included in the booking and accepts responsibility for ensuring that all travellers are aware of, and agree to be bound by, these Terms and Conditions.
Where you request Forward Travel to design and prepare a customised itinerary or tailor-made travel arrangement, a non-refundable customisation deposit of AUD $300 per booking is payable prior to commencement of the itinerary design process. This deposit contributes towards the administrative, research, consultation and planning services undertaken by us in developing your personalised travel arrangements.
The customisation deposit will be credited towards the total cost of your confirmed booking once the travel arrangements are booked. If you choose not to proceed with the booking, or the customised itinerary does not result in a confirmed booking, the customisation deposit will be retained by Forward Travel as payment for services provided and will not be refundable.
Full payment of the balance owing for your travel arrangements must be received by Forward Travel no later than sixty (60) days prior to the commencement of your trip, unless otherwise stated in your booking confirmation or advised by your Consultant. Certain travel arrangements, tours, or Supplier requirements may require payment earlier, additional instalments, or full payment at the time of booking. Where applicable, these requirements will be communicated to you at the time of booking.
If payment is not received by the applicable due date, we will issue a reminder requesting payment. You remain responsible for any costs, fees, charges, or penalties imposed by Suppliers arising from late payment or failure to meet required payment deadlines.
If full payment is not received within seven (7) days after the reminder is issued, Forward Travel reserves the right to treat the booking as cancelled by you. In such circumstances, cancellation fees and charges may apply in accordance with these Terms and Conditions and the applicable Supplier booking conditions.
We may charge fees and surcharges for certain services provided, including but not limited to booking and reservation fees, cancellation or amendment fees, credit card merchant fees, insurance claim administration fees, and fees for additional or ad-hoc services requested or provided.
Payments made to Forward Travel directly by credit card will be capped at $500 (per booking). Payments made to any of our partners or other payment methods that incur processing costs may attract a surcharge to recover the fees charged by payment providers. The applicable surcharge may vary depending on the type of card or payment method used. You are responsible for providing accurate payment details, including the correct card type, to ensure the appropriate surcharge is applied. Forward Travel accepts no responsibility for any incorrect surcharge applied where inaccurate or incomplete payment information has been provided, and any surcharge charged will not be refundable.
By providing payment details, you authorise Forward Travel to charge your nominated credit card or debit card for all amounts payable in connection with your booking, including travel arrangements, fees, charges and any other services arranged or provided by us on your behalf. If any payment is declined, reversed, disputed, or otherwise not received from the card issuer or payment provider for any reason, you agree to pay all outstanding amounts to Forward Travel and its suppliers immediately upon demand.
Once a booking has been confirmed, changes, amendments or cancellations may be subject to fees, charges or restrictions imposed by Forward Travel and/or the relevant Suppliers.
Certain travel arrangements may be non-refundable, non-transferable, or unable to be amended once confirmed. In some circumstances, changes may only be permitted subject to payment of additional fees or charges. It is your responsibility to review the applicable booking conditions, cancellation terms and amendment policies prior to confirming your booking.
Any request to amend or cancel a confirmed booking must be submitted to us in writing. Changes or cancellations may incur Supplier charges in addition to any service fees or charges imposed by Forward Travel. Supplier cancellation, amendment and refund conditions are governed by their respective terms and conditions and may vary depending on the travel arrangements booked.
Where you cancel a booking, cancellation charges will apply based on the date Forward Travel receives written notice of cancellation, calculated as follows:
The cancellation charges set out above represent a genuine and reasonable pre-estimate of the costs, expenses and losses incurred by Forward Travel as a result of cancellation at the relevant stage of the booking process, including costs committed to Suppliers, administrative expenses and services already provided.
For Forward travel’s own group departures, any request to transfer a confirmed booking to an alternative departure date will be treated as a cancellation of the original booking and a new booking request. Cancellation fees and applicable Supplier charges may differ from the standard cancellation fess that apply to any Forward Travel’s tailor-made and private tours. Any difference in policy will be applied accordingly.
You are responsible for ensuring that you meet all health, medical, vaccination, testing and entry requirements applicable to your travel arrangements, including any requirements imposed by airlines, transport operators, accommodation providers, governments or other authorities.
If, due to illness, suspected illness, failure to satisfy required health or vaccination requirements, or any other medical-related circumstance:
and as a result you are prevented from commencing or continuing your trip, the following conditions apply:
(a) If you have already commenced your trip: Forward Travel will provide reasonable assistance, where practicable, to help arrange alternative travel arrangements or support the continuation of your trip. Any costs associated with such arrangements will be your responsibility.
(b) If you have not commenced your trip: Forward Travel will not be in a position to provide alternative arrangements or assistance beyond any obligations required by law.
You acknowledge that we will not be liable to provide a refund of any amounts paid, or any portion of your travel arrangements, where you are unable to travel or continue your trip due to these circumstances. This is because we may have already paid, committed to pay, or become liable for payments to Suppliers, and may have undertaken significant planning, administration and preparation services in connection with your booking.
We will not be responsible for any additional losses, costs or expenses incurred by you as a result of being unable to commence or continue your travel arrangements, including but not limited to airfare costs, visa expenses, accommodation costs, medical expenses or other related expenses.
We strongly recommend that you obtain comprehensive travel insurance at the time of booking, and preferably immediately after payment of your deposit, which provides appropriate cover for cancellation, curtailment, medical expenses, illness and other unforeseen circumstances that may affect your ability to travel.
For the purposes of these Terms and Conditions, Force Majeure means an event or circumstance beyond the reasonable control of Forward Travel, you, or the relevant Supplier, which could not have been reasonably foreseen, prevented, avoided or overcome through the exercise of reasonable care and diligence.
A Force Majeure event includes, but is not limited to:
(a) acts of God, natural disasters or other natural catastrophes, including floods, fires (including bushfires or wildfires), earthquakes, landslides, volcanic eruptions, tsunamis, cyclones, hurricanes, tornadoes, extreme weather events, adverse weather conditions, or unusually high or low water levels;
(b) acts of war (including civil war), armed conflict, military operations, sabotage, terrorism, threats of terrorism, riots, civil unrest, insurrection, coup d’état, civil commotion, national emergency, or the imposition of martial law;
(c) epidemics, pandemics, outbreaks of infectious disease, quarantine requirements, public health emergencies, or other public health crises;
(d) any act, decision, regulation, order, decree, law, restriction, travel advisory, border closure or other requirement imposed by any government authority or regulatory body; and
(e) industrial disputes, national strikes, or significant disruptions to the availability of labour, transportation, fuel, energy, raw materials or essential services beyond the control of the affected party.
For the avoidance of doubt, Force Majeure does not include circumstances arising solely from financial hardship, inability to make a profit, changes in market conditions or prices, currency fluctuations, or a party’s inability to perform its obligations due to insufficient funds or financial resources.
Where a Force Majeure event affects, prevents, delays or materially impacts the performance of your travel arrangements, Forward Travel and/or the relevant Supplier may amend, suspend, postpone or cancel affected services where reasonably necessary. Any rights to refunds, credits, alternative arrangements or other remedies will be determined by the circumstances of the event, the applicable Supplier terms and any rights available to you under the Australian Consumer Law.
If, prior to the commencement of your travel arrangements:
(a) Forward Travel, acting reasonably, determines that your travel arrangements cannot safely, lawfully or reasonably proceed due to a Force Majeure event, whether directly or as a result of actions or restrictions affecting our employees, contractors, Suppliers or agents; or
(b) you notify Forward Travel no more than fourteen (14) days prior to the commencement of your travel arrangements that you are unable to reasonably utilise the travel arrangements due to a Force Majeure event (for example, border closures or government-imposed travel restrictions),
we may, at our discretion:
(i) offer to reschedule your travel arrangements to an alternative date or itinerary, subject to your agreement and availability of the relevant services; or
(ii) cancel the affected travel arrangements, in which case the contract between you and Forward Travel in respect of those cancelled travel arrangements will terminate.
Where Forward Travel cancels your travel arrangements due to a Force Majeure event, neither party will have any liability to the other for damages, losses or compensation arising solely from the cancellation of those travel arrangements.
In the event of such cancellation, we will, at its discretion, either:
(a) issue you with a travel credit equal to the amount of payments received by us for the cancelled travel arrangements, redeemable within twenty-four (24) months from the date of issue against future travel services arranged by Forward Travel; or
(b) provide a refund of amounts attributable to the cancelled travel arrangements, less:
(i) any unrecoverable costs, cancellation fees, charges or expenses imposed by third-party Suppliers or incurred by us in connection with the cancelled travel arrangements;
(ii) any applicable overheads or administrative costs incurred by us in relation to the cancelled travel arrangements; and
(iii) fair and reasonable compensation for services performed by us prior to cancellation, including itinerary planning, consultation, booking administration, supplier coordination and processing of the cancellation and refund.
You acknowledge that Forward Travel’s ability to provide travel credits, refunds or other compensation may depend on the corresponding actions and policies of Suppliers. While we will make reasonable efforts to recover amounts from Suppliers, we cannot guarantee that Suppliers will issue credits or refunds. Where Supplier credits or refunds are unavailable, Forward Travel may provide a reduced cash refund calculated in accordance with the above provisions.
If, after your travel arrangements have commenced, Forward Travel is required to cancel any part of your travel arrangements due to a Force Majeure event, we will provide a refund of any amounts recovered from third-party Suppliers in respect of the cancelled components of your travel arrangements, together with any third-party costs that have not been incurred for those cancelled arrangements.
Where Forward Travel provides a limited cash refund following a Force Majeure event, we will use reasonable endeavours to recover any applicable payments, credits or refunds from third-party Suppliers attributable to your booking. However, you acknowledge that we cannot guarantee that Suppliers will provide refunds, credits or other compensation, either in whole or in part.
If, after providing a limited cash refund to you, or after determining that no cash refund is currently payable, Forward Travel subsequently recovers any amounts from Suppliers that are attributable to your booking, we will pass on the recovered amount to you, less any reasonable costs or charges incurred in obtaining such recovery.
We will not be responsible for any other losses, expenses or costs incurred by you arising from the cancellation, alteration, delay or interruption of your travel arrangements due to a Force Majeure event, including but not limited to airfare costs, travel insurance premiums, visa expenses, accommodation costs, transport costs or other incidental expenses.
If we offer alternative travel arrangements, services or reasonable assistance following the cancellation or rescheduling of travel arrangements due to a Force Majeure event, and you accept such alternatives, you acknowledge and agree that the value of those services or assistance may be deducted from any refund otherwise payable.
You acknowledge that the provisions contained within this Force Majeure section are reasonably necessary to protect Forward Travel’s legitimate business interests, including costs incurred in planning, arranging and delivering travel services. We strongly recommend that you purchase comprehensive travel insurance at the time of booking, and preferably immediately after payment of your deposit, which provides appropriate cover for cancellation, interruption, rescheduling and other risks associated with Force Majeure events.
If we cancel your travel arrangements for reasons other than a Force Majeure event, or where applicable, because minimum participant numbers have not been achieved, you will be entitled to elect either:
(a) a full refund of all monies paid by you in respect of the cancelled travel arrangements; or
(b) an alternative travel arrangement of substantially equivalent quality, where such an option is available and agreed by both parties.
To the maximum extent permitted by law, Forward Travel will not be liable for any additional expenses, losses, costs or damages incurred by you as a result of the cancellation, including but not limited to airfare costs, visa expenses, accommodation expenses, insurance costs or other consequential losses.
This clause does not exclude, restrict or modify any rights or remedies available to you under the Australian Consumer Law or any other applicable legislation.
Forward Travel will use reasonable endeavours to accommodate requests for amendments, alterations or additional services relating to your confirmed booking. However, you acknowledge that such requests may not always be possible due to availability, Supplier restrictions, contractual obligations or other circumstances beyond our control.
Any amendment requested by you after confirmation of your booking will incur an amendment fee of AUD $100 per person to cover the administration, communication, processing and coordination costs associated with managing the change. In addition to this fee, you will be responsible for any additional costs, charges, penalties or fees imposed by Suppliers or other third parties as a result of the requested amendment.
For group departures, a request to transfer your booking to a different departure date or departure group will be treated as a cancellation of the original booking and a new booking request. Applicable cancellation fees and charges will apply in accordance with these Terms and Conditions.
Once a booking has been confirmed, transfers of passenger names are not permitted. Any request to change the traveller name will be treated as a cancellation by you and subject to the applicable cancellation terms and fees.
Once your travel arrangements have commenced, any amendments or changes must be requested and arranged locally through your appointed guide or local representative, where applicable. We will not be responsible for any additional costs, losses or expenses arising from amendments requested after departure.
Due to the dynamic nature of travel arrangements, we reserve the right to make reasonable amendments, modifications or substitutions to an itinerary, inclusions, Suppliers, accommodation, transportation arrangements or other components of your travel arrangements where necessary.
You acknowledge that itineraries are subject to change and that many amendments will be minor and will not materially affect the overall nature, quality or value of your travel arrangements. Examples of minor changes may include, but are not limited to, changes to accommodation, transportation schedules, sightseeing arrangements, activities or other inclusions due to operational requirements or circumstances beyond our control.
If Forward Travel becomes aware of a significant change to your itinerary or inclusions that materially alters the overall characteristics, value or purpose of your travel arrangements, and we determine that the arrangements can reasonably continue, we will notify you within a reasonable timeframe. You may then elect to:
(a) proceed with the travel arrangements, in which case we will provide a reasonable adjustment or refund representing the reduction in value attributable to the significant change, as determined by us acting reasonably; or
(b) cancel the affected travel arrangements, in which case we will refund all monies received by us in respect of the cancelled arrangements.
If you do not notify us in writing of your election within seven (7) days of receiving notice of the significant change, you will be deemed to have elected to proceed with the travel arrangements.
You acknowledge and accept that circumstances may arise during your travel that require changes to the itinerary, transportation arrangements, accommodation, activities or inclusions. Such changes may occur due to circumstances beyond our reasonable control, including but not limited to local conditions, road closures, weather conditions, changes to transport schedules, mechanical issues, operational requirements, safety considerations or Supplier availability.
Forward Travel and/or our local representatives will use reasonable endeavours to minimise disruption and provide suitable alternatives where practicable.
To the maximum extent permitted by law:
(a) Forward Travel will not be liable for omissions, alterations or modifications to your itinerary, inclusions or travel arrangements arising from Force Majeure events or other circumstances beyond our reasonable control occurring after acceptance of your booking, including any associated loss of enjoyment, inconvenience or disappointment;
(b) where you are entitled to any compensation, refund or adjustment as a result of an amendment, omission or modification, you agree that the value of any alternative services, arrangements or assistance provided and accepted by you may be deducted from the amount otherwise payable; and
(c) Forward Travel will not be responsible for any additional expenses, losses, costs or damages incurred by you arising from any amendment, alteration or change to your itinerary, inclusions or travel arrangements, except to the extent required by applicable law.
Any entitlement to a refund arising from the cancellation of your travel arrangements is subject to these Terms and Conditions and the applicable terms and conditions of the relevant Supplier.
Where a refund is payable, we will use reasonable endeavours to obtain the refund from the relevant Supplier on your behalf, unless we expressly agree otherwise in writing. You acknowledge that Forward Travel acts as an intermediary in obtaining Supplier refunds and is dependent upon the Supplier’s approval, processing timeframes and refund procedures.
Where Forward Travel is assisting with the recovery and processing of a refund, any refund amount will not be paid to you until the applicable funds have been received by Forward Travel from the relevant Supplier. We will not be responsible or liable for delays, processing times or failures by Suppliers to provide refunds. Processing times vary between Suppliers and may be extended, particularly for airline refunds, which can commonly take several weeks or longer to process.
Where Forward Travel is entitled to retain service fees, consultation fees, booking fees or other charges for services provided, such amounts will remain payable regardless of whether your booking is subsequently cancelled or a Supplier fails to provide the contracted travel arrangements for any reason, except where caused by our breach of contract or where otherwise required by law. This includes cancellations arising from Force Majeure events.
You must advise your Forward Travel Consultant of any special requirements, preferences or needs relevant to your travel arrangements at the time of booking or as soon as practicable thereafter. This may include, but is not limited to, dietary requirements, meal preferences, seating requests, room configurations, accessibility requirements, mobility considerations or any other assistance required during your travel.
If you do not disclose any special requirements prior to confirmation of your booking, we will proceed on the understanding that no such requirements apply and cannot accept responsibility for any resulting inability to meet those requirements.
You acknowledge that all special requests are subject to availability and confirmation by the relevant Supplier and are not guaranteed unless expressly confirmed in writing by us. While we will use reasonable endeavours to communicate your requests to the relevant Suppliers, we accept no responsibility or liability where a special request cannot be fulfilled or where the Supplier is unable to accommodate your requirements.
Forward Travel’s responsibility is limited to arranging and coordinating your travel arrangements in accordance with your instructions and the services you have requested. You are responsible for obtaining and reviewing all information necessary or desirable to ensure you are suitably prepared for your travel and able to make informed decisions regarding the travel arrangements selected.
We strongly recommend that you review the travel information available on our website as a starting point, including information relating to passports, visas, health requirements, vaccinations, travel documentation and other matters that may affect your ability to travel.
Information provided by us, including website content, travel advice, destination information and other materials, is provided as a general guide only. While we take reasonable care to ensure that information is accurate and current at the time of publication, we do not warrant that such information is complete, exhaustive or continuously updated. Information may not address all matters relevant to your individual circumstances or travel plans.
It is your responsibility to independently verify all requirements applicable to your travel arrangements, including but not limited to passport validity, visa requirements, health and vaccination requirements, entry conditions, travel advisories, insurance requirements and any other obligations that may apply to you.
No refunds will be provided for any travel arrangements, services, activities, accommodation or other inclusions that are not utilised by you, whether due to personal choice, illness, late arrival, early departure, changes to your itinerary, or any other reason beyond Forward Travel’s control.
This includes circumstances where services are missed due to delays, cancellations or schedule changes by airlines, transport operators or other common carriers. We accept no responsibility or liability for any loss, expense or inconvenience arising from such circumstances, except where required by applicable law.
Where a Supplier refuses to provide travel services due to your failure to meet applicable requirements, including health, vaccination, entry or documentation requirements, you acknowledge that you may not be entitled to a refund for the affected services. We will not be responsible for any resulting loss, costs, expenses or loss of enjoyment arising from such refusal.
For security, ticketing and operational purposes, airlines and international Suppliers require all traveller names to be provided exactly as they appear on the traveller’s passport or relevant travel document.
You are responsible for ensuring that all passenger names and personal details provided to Forward Travel are accurate at the time of booking. If incorrect information is provided and amendments, ticket re-issues, cancellations or other corrections are required, you will be responsible for all associated costs imposed by airlines or Suppliers, together with any applicable Forward Travel administration fees.
Comprehensive travel insurance is a condition of booking with Forward Travel. You are responsible for ensuring that you obtain adequate insurance cover for the duration of your travel arrangements. We strongly recommend that your policy provides appropriate cover for cancellation, medical expenses, emergency evacuation and repatriation, personal belongings, travel delays, disruption, and other unforeseen circumstances.
The choice of insurer and policy is yours; however, we strongly recommend purchasing travel insurance as soon as your deposit has been paid, as cancellation fees and other charges may apply from that time.
Due to the nature of international travel and the operational requirements of Suppliers, we may occasionally need to substitute hotels, lodges, vessels or other accommodation with alternative properties or vessels of a comparable or higher standard. We will use reasonable endeavours to minimise any such substitutions. You acknowledge that a substitution to accommodation or other services of a comparable standard will not constitute a significant change to your travel arrangements.
You are responsible for ensuring that you hold a valid passport, appropriate visas and all other required travel documentation necessary for your journey.
Your passport must have sufficient validity and comply with the entry requirements of all countries visited. Your passport name must exactly match the name provided for airline tickets and travel documentation. Failure to provide accurate documentation or meet entry requirements may result in denied boarding, refusal of entry or additional costs, for which we accept no responsibility.
Visa, entry and exit requirements can change without notice. It is your responsibility to obtain current and accurate information from the relevant embassy, consulate or government authority prior to travel.
Forward Travel may provide general destination information as a guide only but does not provide immigration or visa advice. If you require assistance obtaining a visa, you should engage an appropriately qualified visa processing provider.
You are responsible for obtaining all vaccinations, preventative medicines, health clearances and other medical requirements applicable to your travel arrangements. We strongly encourage travellers to seek advice from a qualified medical professional or travel health clinic regarding recommended vaccinations and preventative measures before departure.
Any health-related information provided by us is provided in good faith as general guidance only and does not constitute medical advice.
You are responsible for ensuring that you have an appropriate level of health and fitness to participate in your chosen travel arrangements. Some itineraries may involve remote locations, challenging conditions, physical activities, long travel periods or limited access to medical facilities.
If you have any concerns regarding your ability to undertake your chosen travel arrangements, you should discuss these with us prior to booking.
You must advise Forward Travel at the time of booking of any medical condition, disability or other circumstance that may reasonably be expected to increase your need for medical assistance or materially affect the normal operation of your travel arrangements. We may request a medical assessment from a suitably qualified medical practitioner where reasonably required to determine whether you are fit to travel or whether any additional assistance can reasonably be provided.
If the medical assessment indicates that you are unable to safely participate in the travel arrangements, or require assistance that cannot reasonably be provided, we may cancel your booking. Provided you disclosed the condition at the time of booking, any refund will be limited to amounts recoverable by us, less any applicable administrative fee of AUD $250 per person and any non-refundable Supplier charges.
Failure to provide requested medical information or assessment within a reasonable timeframe will be treated as a cancellation by you and applicable cancellation fees will apply.
You must advise us of any new or changed medical conditions arising after booking that may reasonably increase your need for medical assistance or materially affect the delivery of your travel arrangements. Forward Travel may request a medical assessment from a suitably qualified medical practitioner. If you require assistance that cannot reasonably be provided, or if you fail to
provide requested medical information within a reasonable timeframe, your booking may be treated as cancelled by you and applicable cancellation fees will apply.
If you fail to disclose a medical condition and, as a result, you require assistance that Forward Travel or our Suppliers cannot reasonably provide, we reserve the right to exclude you from the travel arrangements. Any such exclusion will be treated as a cancellation by you and applicable cancellation fees and charges will apply.
Due to the highly personalised nature of the journeys designed by Forward Travel, and our commitment to maintaining traveller comfort, privacy, safety and overall experience quality, we do not generally offer room-share matching services or create shared travel arrangements between travellers who do not already know each other.
In exceptional circumstances, we may consider a request for shared accommodation or paired arrangements on a case-by-case basis. Any such arrangement will be subject to our approval, availability, suitability of the circumstances and the agreement of all parties involved.
Where Forward Travel agrees to facilitate a shared accommodation arrangement, you acknowledge that we cannot guarantee compatibility between travellers and accept no responsibility or liability for the personal preferences, behaviour, expectations or suitability of any other traveller sharing accommodation.
When participating in a group tour operated or arranged by Forward Travel, you agree to conduct yourself in a manner that is respectful, considerate and conducive to the safety, wellbeing and enjoyment of all travellers, guides, staff and Suppliers. If, in the reasonable opinion of the Tour Leader or Forward Travel representative, your behaviour threatens the safety of yourself or others, materially disrupts the enjoyment of the group, breaches local laws or significantly impacts the operation of the tour, you may be required to leave the tour or travel arrangements.
In such circumstances, we will have no liability to refund any unused services, and you will be responsible for any additional costs incurred, including accommodation, transportation, meals, return travel arrangements or other expenses arising from your removal from the tour.
Certain Forward Travel group departures may be subject to a minimum number of participants travelling. Where applicable, this requirement will be disclosed prior to confirmation of your booking.
If minimum numbers are not achieved, Forward Travel reserves the right to cancel the departure or revise the pricing of the travel arrangements. We will notify you no later than sixty (60) days prior to the scheduled commencement of travel if the departure is unable to proceed on the original basis.
Where a departure is re-costed due to insufficient numbers, you may elect to:
(a) accept the revised price and proceed with the travel arrangements; or
(b) cancel your booking and receive either a refund of payments made towards the affected travel arrangements or a credit of those amounts towards alternative travel arrangements offered by us.
You must advise us of your election in writing within seven (7) days of receiving notification of the revised arrangements. If we do not receive your response within this timeframe, we may proceed on the basis that you have accepted the revised arrangements. Forward Travel will not be responsible for any additional travel arrangements, costs or expenses you have made independently, including flights, accommodation, visas, insurance or other arrangements affected by the cancellation or amendment of the group departure.
Forward Travel is not responsible for any optional activities, excursions, extensions or services that are not included within your booked itinerary, or which are arranged by you independently.
Where Forward Travel recommends, facilitates or sells an optional activity or excursion as an agent for a third-party operator, your contract for that service will be with the relevant principal operator or Supplier, and their terms and conditions will apply.
Any advice, recommendation or information provided by us, our guides or local representatives regarding independent activities or excursions is provided in good faith based on information available at the time. Such recommendations do not constitute an acceptance of responsibility or liability by Forward Travel for the acts, omissions, performance or conduct of any third-party operator or Supplier.
You acknowledge and accept that travel involves inherent risks, some of which may be greater than those ordinarily encountered in everyday life. These risks may arise from the nature of the travel arrangements, including adventure activities, remote locations, challenging environments, wildlife encounters, differing standards of infrastructure and services, or destinations involving geographical, political, social, cultural or security-related risks.
You are responsible for making an informed decision regarding your participation in travel arrangements and should review relevant travel advice issued by the Australian Department of Foreign Affairs and Trade (DFAT) for the destinations included in your itinerary. By choosing to travel, you acknowledge that you have considered available travel advice and voluntarily accept the inherent risks associated with your travel arrangements.
To the maximum extent permitted by law, Forward Travel will not be liable for any injury, illness, death, damage, loss (including consequential loss), delay, additional expense, inconvenience or disruption arising directly or indirectly from:
(a) the acts, omissions, negligence or default of third-party Suppliers, operators or service providers over whom we has no direct control;
(b) any event of Force Majeure affecting you, Forward Travel or any Supplier; or
(c) any other event, circumstance or occurrence beyond Forward Travel’s reasonable control or which could not have been prevented through the exercise of reasonable diligence.
Where Forward Travel’s liability cannot be excluded by law, and where such liability may be limited, that liability will be limited to the remedies required under applicable legislation, including the Australian Consumer Law.
To the fullest extent permitted by law, Forward Travel excludes liability for consequential losses, including but not limited to loss of enjoyment, loss of opportunity, disappointment, inconvenience or loss of amenity.
Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights or remedies available to you under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
Any obligation owed by us to you will be suspended to the extent that we are prevented from, or delayed in, performing that obligation due to a Force Majeure event.
Your rights and remedies in relation to confirmed travel arrangements affected by a Force Majeure event may also be subject to the applicable terms and conditions of the relevant Supplier.
Forward Travel, at times, acts as an intermediary and arranges travel products and services on behalf of various third-party travel providers, including transport operators, accommodation providers and other travel service providers such as airlines, coach operators, rail operators, cruise lines, tour operators and travel wholesalers (Suppliers).
We are not the provider of the travel products and services supplied by these Suppliers and do not control, operate or manage those services. Our role is to provide advice, facilitate bookings, coordinate arrangements and act with reasonable care in selecting reputable Suppliers and arranging travel products and services on your behalf. Your oral or written instructions to Forward Travel constitute your authority for us to make bookings and enter into arrangements with Suppliers on your behalf. All bookings are made subject to the Supplier’s applicable terms and conditions, including conditions of carriage, cancellation terms and limitations of liability.
We strongly recommend that you review these terms and conditions before finalising your booking, and we can provide copies of relevant Supplier terms and conditions upon request. You acknowledge that your contractual relationship for the supply of travel products and services may be directly with the relevant Supplier. Any claims, remedies or rights arising from the provision, failure to provide, quality, safety or performance of those travel products and services must be directed to the relevant Supplier, except to the extent that the issue is directly caused by a breach, negligence or fault on the part of Forward Travel.
Forward Travel exercises reasonable care in selecting reputable Suppliers; however, we do not accept responsibility or liability for the acts, omissions, negligence, defaults, failures or insolvency of Suppliers or for the travel products and services they provide, where such matters are not caused by our own fault or negligence.
For the avoidance of doubt, if a Supplier is unable to provide a travel product or service, either wholly or to the expected standard, for reasons not caused by us, your rights and remedies are against that Supplier and not against Forward Travel.
Forward Travel may receive commissions, fees, incentives, gifts or other financial benefits from Suppliers in connection with travel products and services that we recommend, advise on, arrange or sell on your behalf.
Any brochures, destination information, promotional materials or other information provided by us may be supplied by Suppliers or prepared by us using information provided by Suppliers. While we take reasonable care in providing such information, we do not accept responsibility for errors, omissions or inaccuracies contained in Supplier-provided materials.
Where Forward Travel directly provides or controls a travel service or product, we will provide those services with reasonable care and skill. We are responsible only for the acts and omissions of our employees acting within the scope of their employment, and our contractors or agents where we have direct control over their activities and they are performing services authorised by us.
Forward Travel will not be responsible for any loss, damage, injury, expense, delay or claim arising from:
(a) your own acts, omissions, negligence or failure to comply with reasonable instructions;
(b) the acts, omissions or defaults of third parties not involved in the direct provision of the services;
(c) any Force Majeure event; or
(d) circumstances beyond our reasonable control.
Where Forward Travel supplies recreational services, to the maximum extent permitted by law, we exclude liability for death, physical injury, mental injury or other liability referred to in section 139A(3) of the Competition and Consumer Act 2010 (Cth), arising from a failure to comply with a consumer guarantee applicable to recreational services under Subdivision B of Division 1 of Part 3-2 of the Australian Consumer Law.
This exclusion does not apply to significant personal injury caused by Forward Travel’s reckless conduct.
For the purposes of this clause, recreational services include participation in:
(a) sporting activities or similar leisure pursuits; or
(b) activities that:
(i) involve a significant degree of physical exertion or physical risk; and
(ii) are undertaken for recreation, enjoyment or leisure purposes.
To the maximum extent permitted by law, Forward Travel will not be liable for any loss, damage, injury, delay, additional expense, inconvenience or consequential loss arising from:
(a) the acts, omissions or failures of Suppliers or other third parties;
(b) delays, cancellations or changes by airlines, transport operators or other service providers;
(c) Force Majeure events; or
(d) circumstances beyond Forward Travel’s reasonable control.
Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or applicable consumer protection legislation.
Except for rights and remedies that cannot be excluded by law, Forward Travel excludes all other warranties, representations and guarantees.
Where liability cannot be excluded and liability may lawfully be limited, Forward Travel’s liability is limited, at our option, to:
(a) supplying the relevant services again; or
(b) paying the reasonable cost of having those services supplied again.
This limitation applies to the maximum extent permitted by applicable law.
If you experience any issue, concern or problem during your travel arrangements, you must notify Forward Travel, our representative, or the relevant local Supplier as soon as reasonably practicable. Providing prompt notice allows us and/or the relevant Supplier the opportunity to investigate the issue and, where possible, take reasonable steps to resolve the matter while you are travelling.
If a concern raised during travel is not resolved to your satisfaction, you must provide Forward Travel with written details of the complaint within thirty (30) days of completion of your travel arrangements. This allows us the opportunity to investigate the matter, liaise with relevant Suppliers and pursue any applicable remedies on your behalf.
Failure to follow this complaints procedure may affect our ability to investigate the matter, seek resolution from Suppliers, or properly assess any claim, and may limit your rights to pursue a claim to the extent permitted by law.
If you make a booking on behalf of another traveller or travellers, you represent and warrant that you have the authority to accept these Terms and Conditions on behalf of all persons included in the booking. By making the booking, you agree that all travellers in the booking are bound by these Terms and Conditions and that you will be responsible for any loss, liability, cost or damage incurred by Forward Travel arising from a breach of this authority or representation.
During group tours or other travel arrangements, Forward Travel, our representatives or authorised partners may take photographs, videos or other recordings of travellers and activities that may identify you.
By participating in a Forward Travel tour, you consent to us using such images, recordings or likenesses for promotional, marketing, educational and communication purposes across our website, social media channels, publications, advertising materials and other business-related platforms, without payment or compensation being payable to you.
If you do not consent to the use of your image, likeness or recordings, you must notify us in writing at least fourteen (14) days prior to the commencement of your tour. We will make reasonable efforts to respect your request; however, you acknowledge that you may appear incidentally in group photographs or recordings taken in public or shared environments.
Travel documents are generally provided electronically and will be issued to you or your nominated travel agent by email approximately twenty-one (21) days prior to the commencement of your tour, provided that full payment has been received and all required documentation, information and forms have been supplied.
If you intend to commence travel earlier than the scheduled departure date, you must notify Forward Travel as soon as possible so that we can endeavour to provide your travel documents prior to your departure from home. Forward Travel cannot guarantee that documents will be available earlier than the standard release timeframe.
Where you have booked through a Forward Travel Consultant, it is your responsibility to ensure that all travel documents have been received, reviewed and retained prior to departure. Where physical collection has been arranged, documents will generally be available approximately two (2) weeks prior to departure, subject to the nature of your travel arrangements and completion of all required booking requirements.
If you have booked online, you are responsible for downloading, reviewing, retaining and carrying all travel documents provided to you, including itineraries, confirmations, vouchers, tickets and other relevant travel information required for your journey. You are responsible for checking all travel documents upon receipt and notifying Forward Travel immediately of any errors, omissions or discrepancies.
If you are a member of a frequent flyer program or other loyalty program, it is your responsibility to provide your membership details to your Forward Travel Consultant at the time of booking or as soon as possible thereafter to allow these details to be included in your reservation where applicable.
While we will use reasonable endeavours to provide your loyalty program details to the relevant Supplier, you acknowledge that we cannot guarantee that points, credits, status benefits or other rewards will be awarded. The awarding of loyalty points or benefits is determined solely by the relevant airline, Supplier or loyalty program provider and is subject to their applicable terms and conditions. We accept no responsibility or liability where loyalty points, credits or benefits are not awarded, are incorrectly credited, expire, or are otherwise unavailable.
Where a Forward Travel tour is identified as a Guaranteed Departure, the tour is confirmed to operate regardless of the number of participants booked, subject to the provisions of these Terms and Conditions. We reserve the right to withdraw a Guaranteed Departure status, amend, postpone or cancel a tour where circumstances arise beyond our reasonable control, including a Force Majeure event.
Guaranteed Departures may be costed on the basis of a minimum number of participants travelling. If the number of participants reduces below the basis on which the tour was priced, Forward Travel reserves the right to review and amend the tour price to reflect the increased costs of operating the departure.
Where a departure is not identified as a Guaranteed Departure and minimum participant numbers are not achieved, we reserve the right to cancel or withdraw the departure. Where practicable, we will provide notice of cancellation as soon as reasonably possible and aim to provide notice no later than sixty (60) days prior to departure.
If a departure is cancelled due to insufficient numbers, you may elect to receive either:
(a) a refund of all monies paid to us for the cancelled travel arrangements; or
(b) a credit towards alternative travel arrangements offered by Forward Travel.
We will not be responsible for any additional expenses, losses or costs incurred as a result of cancellation, including but not limited to flights, accommodation, visas, insurance or alternative travel arrangements made independently by you.
Where airport transfers are included as part of your Forward Travel itinerary, transfers will generally be provided on the scheduled arrival and departure days of the tour only and are subject to the operating hours, availability and requirements of our local Suppliers.
You must provide complete and accurate flight details no later than seven (7) days prior to arrival. Failure to provide required flight information may result in transfers being unavailable.
Once airport transfers have been confirmed, changes may not be possible. Unless otherwise stated, transfers are provided as shared group transfers, with one arrival transfer and one departure transfer included per traveller. Forward Travel accepts no responsibility where transfers cannot operate due to circumstances beyond our control, including flight delays, cancellations, changes to flight schedules or late arrival outside Supplier operating hours.
No refund will be provided for unused, missed or declined transfers. It is your responsibility to ensure that any transfer arrangements allow sufficient time for airport check-in, connections and other travel requirements. We will not be liable for missed flights, additional costs or cancellation charges arising from delays or changes affecting airport transfers.
Descriptions of destinations, tours, accommodation, activities and services provided by Forward Travel are based on information supplied by Suppliers and are intended as a general guide only.
While Forward Travel takes reasonable care to ensure information provided is accurate at the time of publication, we do not warrant that descriptions, photographs, maps or other materials are complete, current or free from errors or omissions. Facilities, inclusions, accommodation standards, routes, schedules and services may change due to operational requirements, Supplier decisions or circumstances beyond our control.
Maps are provided for general reference only and may not accurately represent actual routes, distances or locations. Photographs may depict destinations, accommodation or activities in the general region visited but may not necessarily represent the exact inclusions of your itinerary.
Baggage allowances, restrictions and charges vary between airlines, transport operators and Suppliers. You are responsible for confirming applicable baggage requirements directly with the relevant carrier where required.
Where hotel porterage is included, it generally applies to one standard suitcase per person while travelling as part of the organised group only. Porterage is not included for independent hotel check-ins or check-outs before or after the tour unless otherwise stated.
All baggage and personal belongings remain entirely at your own risk at all times. We strongly recommend comprehensive travel insurance that provides appropriate cover for baggage loss, theft, damage and delays.
You are responsible for ensuring that any souvenirs, artefacts, cultural items or goods purchased during your travel comply with all applicable customs, quarantine, import, export, transportation and legal requirements.
You are responsible for arranging appropriate transportation, insurance, permits, certification, fumigation or shipping requirements for any purchased items.
Forward Travel accepts no responsibility or liability for the loss, damage, delivery, transportation, legality or importation of any goods purchased by you during your travel arrangements.
You should not provide money or valuables to guides, drivers or local representatives to transport goods on your behalf unless through an appropriately authorised and insured courier service with verifiable tracking.
Forward Travel endeavours to ensure that all included travel services are prepaid and arranged prior to your arrival. However, in some destinations, particularly developing tourism regions or remote areas, local circumstances may occasionally require additional payment for incidental expenses such as fuel, water or locally required services.
You should not provide cash payments to any person claiming to represent Forward Travel unless such payment has been expressly authorised by Forward Travel in writing. If you are requested to make an additional payment during travel, you should contact Forward Travel or the designated emergency contact immediately for verification and assistance.
Forward Travel accepts no responsibility for unauthorised payments made by you to guides, drivers, suppliers or other persons without prior approval.
Forward Travel reserves the right to refuse participation in, or remove a traveller from, a tour or travel arrangement where reasonably necessary to protect the safety, wellbeing and enjoyment of other travellers, Suppliers, employees or representatives.
This may include circumstances where a traveller:
(a) engages in threatening, disruptive, abusive, unsafe or inappropriate behaviour;
(b) is unable to participate due to physical, medical or psychological circumstances;
(c) fails to comply with reasonable instructions from Forward Travel representatives or Suppliers;
(d) breaches local laws, regulations or safety requirements; or
(e) possesses prohibited items or substances.
Where a traveller is removed from a tour, we will not be responsible for any unused services, refunds or additional expenses incurred. Any onward travel arrangements, accommodation or related costs will be at the traveller’s own expense.
You must provide us with accurate contact details, including a current telephone number, email address and/or emergency contact details, so that we can communicate important travel information where required.
Travel documentation may not be issued until all required contact information has been provided.
Air travel arrangements are subject to the airline’s applicable conditions of carriage, fare rules, limitations of liability and operational requirements. Airfares, schedules, availability and taxes may change at any time and are subject to the terms and conditions imposed by the relevant airline.
Where a booking is made through an independent travel agent, Forward Travel’s obligations in relation to that booking commence only upon receipt of applicable payments from the travel agent.
Travel agents are responsible for ensuring that customers receive accurate booking information, invoices, itineraries and documentation, and that customers are made aware of these Terms and Conditions, amendment fees, cancellation policies and other applicable booking requirements.
Travel agents must provide customers with access to these Terms and Conditions prior to booking. Travel agents are not authorised to amend, waive or vary these Terms and Conditions unless expressly authorised by Forward Travel in writing.
These Terms and Conditions, and any contract between Forward Travel and you, are governed by the laws of New South Wales, Australia. Any dispute arising in connection with these Terms and Conditions will be subject to the jurisdiction of the courts of New South Wales.
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.
Any personal information collected by Forward Travel will be handled, stored, used and disclosed in accordance with applicable privacy laws, including the Australian Privacy Principles, and our Privacy Policy available at Forward Travel Privacy Policy
Before confirming a booking with Forward Travel, you acknowledge and agree that you are responsible for ensuring that:
You are responsible for independently confirming departure times, meeting points, check-in requirements and other operational details for booked services no later than twenty-four (24) hours prior to travel, unless otherwise advised by Forward Travel.
